Sales Contract and Health Guarantee
This document constitutes a legally binding contract between the undersigned purchaser (“Purchaser”) and Arkansas Labs. The parties agree as follows:

1. Transaction. Arkansas Labs hereby sells, and Purchaser hereby purchases, (the Puppy)

Purchaser shall pay a nonrefundable deposit of $100 which shall be applied toward the price of the Puppy.

Arkansas Labs assumes the cost of caring for pre-sold Puppies through 7 weeks of age without charge. After 8 weeks of age, Arkansas Labs assesses a boarding fee of $35 per week, plus the charges for any vaccines or other healthcare that come due.

The deposit may be moved to a different litter or puppy without penalty until the Puppy reaches 4 weeks of age.

Transfer of Possession. The Puppy shall be transferred to the possession of the Purchaser or an agent designated by the Purchaser on(Date)__. The Puppy’s veterinary records, breeding records, and microchip registration shall be delivered to the Purchaser or the Purchaser’s designated agent at the time possession of the Puppy is transferred.
a. Transfer may be delayed temporarily if, after execution of this contract but before leaving Arkansas Labs’ facility, a pre-sold Puppy shows symptoms of parasitic, fungal, viral, or bacterial infection. In such an event, Arkansas Labs will notify the Purchaser and shall keep the Purchaser informed of the Puppy’s health. If the Puppy’s health remains an issue for more than 72 hours, Arkansas Labs will offer the Purchaser the option of an exchange as provided in Paragraph 6a below.
3. Transportation. Purchaser is responsible for picking up and transporting the Puppy from Arkansas Labs’ facility to the Purchaser. If the Purchaser designates an agent for purpose of this transfer (such as a transport service or a family member), Purchaser shall identify the agent to Arkansas Labs prior to the date of transfer.

Once the Puppy leaves Arkansas Labs’ facility, Arkansas Labs has no control over the Puppy’s exposure to infections agents or disease vectors and shall have no further responsibility for the Puppy’s security, safety, or health.

Purchasers must provide their own pet carriers and dishes. Arkansas Labs recommends that Purchasers using third-party transportation services supply the service with a new carry-on soft crate and water dish to avoid possible contamination from other animals.

c. Travel and going to a new home is stressful for animals. Arkansas Labs recommends adding plain canned pumpkin to their food and giving them plain yogurt or cottage cheese to prevent or alleviate stress-related diarrhea, and maintaining the Puppy on familiar food and supplements.

Health Guarantee. This guarantee is non-transferrable and applies only to the original Purchaser.

At the time of transfer of the Puppy from Arkansas Labs to the Purchaser, the Puppy shall have had immunizations appropriate for its age, and shall have been dewormed at 3, 5, 6, and 7 weeks of age.

No Puppy shall be transferred to a Purchaser before the age of 6 weeks or before receiving its first round of vaccinations.

Arkansas Labs guarantees the Puppy to be free of life-threatening genetic disease and congenital defects within the first year of its life. If a life-threatening genetic disease or congenital defect is discovered by a veterinarian within the first year of the Puppy’s life, the Purchaser may receive a replacement Puppy pursuant to the procedure in paragraph 6b below.

Arkansas Labs guarantees that the Puppy will be free of hip dysplasia caused by genetic defect for 12 months of age, or up to 24 months of age if the Puppy is kept on Nuvet supplements. This guarantee is void if the Puppy becomes overweight or if its developing joints are over-stressed by exercise or intense training.

Arkansas Labs does its best to control common problems such as parasites, worms, coccidia, kennel cough, and giardia, but these are common, easily treated problems, symptoms of which are not always apparent until the puppy is stressed, such as when it goes to a new home. Arkansas Labs does not offer a guarantee against these conditions.

Arkansas Labs cannot and does not guarantee any of the following: hip dysplasia attributable to non-genetic causes, umbilical hernias, non-life-threatening genetic anomalies or defects such as undescended testes, underbites or overbites), size, temperament, color, infertility, coat or skin problems, hypoglycemia, eye defects (including but not limited to entropion and cherry eyes, which are common to the breed), or any other common health issues such as diarrhea, allergies, or common parasites such as ear mites, worms, ticks, or fleas.

Purchaser acknowledges that Arkansas Labs cannot pre-diagnose a Puppy showing no symptoms of defect or illness, and therefore holds Arkansas Labs harmless for any expenses associated with any Puppy that displays symptoms of defect or illness that become apparent only after transfer has been accomplished.

Care of the Puppy. Once possession of the Puppy is transferred from Arkansas Labs to the Purchaser or an agent of the Purchaser, Arkansas Labs shall no longer be responsible for any costs associated with the Puppy, including but not limited to feeding, veterinary care, medications, transportation, or grooming.
a. Within 72 hours of taking possession of the Puppy, Purchaser shall have the Puppy examined by a veterinarian of the Purchaser’s choice. Documentation of this veterinary care visit shall be delivered to Arkansas Labs within seven (7) days
of the visit. The documentation shall include lab results, status results, and other findings by the veterinarian, as well as any recommendations for follow-up veterinary care.

The Purchaser will comply with the veterinarian’s recommended schedule for immunizations, wellness checks, and medications.

Purchaser shall keep the Puppy’s microchip registration updated.

Purchaser shall maintain the Puppy on the same NuVet Plus Canine dietary
supplements until the Puppy reaches the age of 24 months. Any changes in diet and supplements should be undertaken only at the direction of the Puppy’s veterinarian.

Purchaser shall not expose the Puppy to potentially unvaccinated dogs, including in places like pet stores or dog parks, until the Puppy has received a minimum of 4 scheduled vaccinations (usually at 16 weeks of age).
6. Exchanges and Replacements. Exchanges and replacements are only permitted under the circumstances described in paragraphs 2a, 4b, and 4c, above.

To qualify for an exchange pursuant to Paragraph 2a, the Puppy must be under veterinary care by Arkansas Labs veterinarian for at least 72 hours, at least part of which must occur on the date of the anticipated transfer of possession of the Puppy from Arkansas Labs to the Purchaser, and the transfer must not have occurred on the anticipated date of transfer. If the preceding conditions are met, the Purchaser may:

choose another Puppy from those currently available and not pre-sold at Arkansas Labs, or
-
elect to choose another Puppy from another litter born at Arkansas Labs’ facility within twelve months of the original date of transfer.

To qualify for a replacement pursuant to Paragraph 4c, the Purchaser must:
-
notify Arkansas Labs within 24 hours of the Puppy’s diagnosis or death,
and within the first 12 months of the Puppy’s life and;
-
within seven days of the initial notice, provide documenting information from a veterinarian who has examined, assessed, and tested the Puppy to
the extent reasonably necessary to diagnose a genetic or congenital defect in the Puppy. This information includes but is not limited to copies of laboratory results, x-rays or other imaging, a letter on the veterinarian’s letterhead stating the diagnosis and the basis upon which the diagnosis was made and stating that the condition cannot be corrected with any known modern therapies or surgery, or, if the Puppy has died within the first 12 months of life, provide such documentation from the treating veterinarian to show that the Puppy’s death was caused by its genetic or congenital defect.

If the preceding conditions are met, the Purchaser may:

choose another Puppy from those currently available and not
pre-sold at Arkansas Labs, or
-
elect to choose another Puppy from another litter born at Arkansas
Labs’ facility within twelve months of the original date of transfer.

To qualify for a replacement pursuant to Paragraph 4d, the Purchaser must:
-
notify Arkansas Labs within the first 12 months of the Puppy’s life (or 24 months of age if the Puppy has been maintained on NuVet supplements) and within 72 hours of the Puppy’s diagnosis; and
-
within seven days of the initial notice, provide documenting information from a veterinarian who has examined, assessed, and tested the Puppy to the extent reasonably necessary to diagnose a genetic hip dysplasia in the Puppy. This information includes but is not limited to copies of laboratory results, x-rays or other imaging, a letter on the veterinarian’s letterhead stating the diagnosis and the basis upon which the diagnosis was made and stating that the condition cannot be corrected with any known modern therapies or surgery, as well as an evaluation report from the Orthopedic Foundation for Animals (OFA). (Purchaser’s veterinarian can obtain this report.)

Upon the Purchaser’s compliance with Paragraph 6b or 6c, Arkansas Labs will verify the findings and diagnosis of the Purchaser’s veterinarian with its own veterinarian. The Purchaser agrees to facilitate cooperation between the Purchaser’s veterinarian and the veterinarian for Arkansas Labs so that the veterinary professionals may agree as to a diagnosis. If the veterinarians agree as to the diagnosis, the Purchaser may:

Provide proof of the Puppy’s death, and within twelve months, choose another Puppy of the same color and gender from Arkansas Labs (adjusting the price relative to any difference in value of the puppies); or
-
Keep the Puppy and
-
Provide proof that the Puppy has been sterilized and that it has not
or will not be used for breeding, and promptly return any AKC
registration to Arkansas Labs; and
-
Within twelve months, choose another Puppy of the same color
and gender from Arkansas Labs (adjusting the price relative to any
difference in value of the puppies).

Transportation of any Puppy selected for exchange or replacement shall be at the
Purchaser’s expense and shall take place under the same terms and conditions described in Paragraph 3 above.

Notices. Any notices or documentation required by this contract shall be provided to the parties at their addresses below or delivered in-person.

Controlling Law. This Contract and Guarantee are entered into in the State of Arkansas, and Arkansas law controls this transaction. Any legal process related to this contract shall be brought in a court of competent jurisdiction in the State of Arkansas.

Complete Agreement. The parties to this Contract and Guarantee have read it, understand it, and have had the opportunity to consider it. They agree to it freely, without coercion, threat, or undue influence. This document represents the entire understanding of the Parties. Any modification of the terms of this contract shall be made in writing and signed by the parties.
